The case stems from a claim made by Dr. Fleur Tehrani that the INTELLiVENT-ASV () ventilator control systems from Hamilton Medical infringe certain claims of Tehrani’s US ‘571 patent. In its final written decision issued on December 28, 2021, the U.S. Patent and Trademark Office Patent and Appeal Board held that all patent claims of the Tehrani US ‘571 patent challenged by Hamilton are “unpatentable.”
This decision clears the way for Hamilton to proceed with pending FDA approval of INTELLiVENT-ASV for entry into the US market.
